Terms of Service

Hesgram provides cloud-hosted automated trading software that connects to your existing MetaTrader 5 (MT5) broker account via the MetaApi service and executes trades according to pre-configured strategies and AI-generated signals.

The service includes:

• A web dashboard (hesgram.com) for monitoring, configuration, and analytics.
• iOS and Android mobile apps for remote monitoring and emergency stop.
• A macOS menu bar application.
• An AI reasoning engine powered by DeepSeek and machine learning models (XGBoost, LSTM, HMM).
• ForexFactory news integration for event-based trading.

We reserve the right to add, modify, or remove features at any time with reasonable notice.

You must be at least 18 years old and legally permitted to trade forex in your country of residence to use Hesgram. By registering, you confirm that:

• You are 18 or older.
• Forex trading is legal in your jurisdiction.
• You are not a US person subject to CFTC or NFA restrictions unless you have confirmed this is permissible.
• You understand that automated forex trading involves substantial financial risk.

You are responsible for keeping your login credentials secure. You must not share your account with anyone. You are responsible for all activity carried out under your account.

If you suspect unauthorised access to your account, you must notify us immediately at security@hesgram.com and change your password. We will not be liable for losses arising from unauthorised account use where you have failed to keep your credentials secure.

You may connect up to the number of MT5 broker accounts permitted by your subscription plan. You must have the right to operate any account you connect.

You agree not to:

• Use Hesgram for any unlawful purpose including money laundering or market manipulation.
• Attempt to reverse-engineer, decompile, or extract source code from the service.
• Use automated scripts or bots to interact with the Hesgram web interface beyond normal API usage.
• Circumvent rate limits, abuse the API, or deliberately cause denial-of-service conditions.
• Resell, sublicense, or commercially redistribute the service without our written consent.
• Provide false information during registration or billing.

We reserve the right to suspend or terminate accounts that violate these restrictions immediately and without refund.

Subscription. Paid plans are billed monthly or annually in advance. Prices are shown in GBP inclusive of applicable VAT. Your subscription renews automatically on the same day each billing cycle unless you cancel before the renewal date.

Free plan. The free plan has no charge and is limited to paper trading with two currency pairs. We may change or discontinue the free plan with 30 days’ notice.

Payment processing. All payments are handled by Stripe. By subscribing, you authorise Stripe to charge your payment method on the recurring schedule you select. We do not store your card details.

Refunds. You may request a full refund within 7 days of your first subscription payment if you have not executed any live trades. After 7 days or after live trading has commenced, all payments are non-refundable. This does not affect your statutory rights.

Cancellation. You can cancel your subscription at any time from your account settings. You will retain access until the end of the current billing period. No refund is issued for the unused portion of a billing period.

Price changes. We will give at least 30 days’ notice before increasing prices. Continued use after that date constitutes acceptance of the new price.

Hesgram is software. Nothing on this platform constitutes financial advice, investment advice, or a recommendation to trade any particular instrument or strategy.

The AI signals, win rates, and ML predictions shown in the Hesgram dashboard are algorithmic outputs — they are not guaranteed, and past performance does not guarantee future results. You remain solely responsible for any trading decisions made using the service.

We are not authorised or regulated by the Financial Conduct Authority (FCA) or any equivalent body. If you require regulated financial advice, consult an independent financial adviser.

All software, designs, trademarks, and content within the Hesgram platform are owned by or licensed to Hesgram Ltd. Nothing in these Terms grants you ownership of any intellectual property.

You own all data generated by your own trades. You grant us a limited, non-exclusive licence to use anonymised and aggregated trade data to improve our ML models.

To the fullest extent permitted by law:

• We are not liable for any trading losses, whether arising from a bug, outage, incorrect signal, or any other cause related to the service.
• We are not liable for losses caused by third-party services including MetaApi, your broker, Stripe, or DigitalOcean.
• Our total aggregate liability to you for any claims arising out of these Terms will not exceed the amount you paid us in the three months preceding the claim.
• We are not liable for indirect, consequential, special, or punitive damages.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

You may close your account at any time from Settings → Account → Close Account. On closure, all live bot activity will be stopped and open positions will not be automatically closed — you must manage any open trades manually in your MT5 terminal.

We may suspend or terminate your account immediately if you breach these Terms, if required by law, or if we have reasonable grounds to suspect fraud or abuse. In the event of termination for breach, no refund will be issued.

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer entitled to bring proceedings in your country of residence.

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance. If you do not accept the new Terms, you may cancel your account before the effective date.
